Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of the Nodum Terms of Service and applies to all users of the Nodum Platform and Services. By using the Services, you agree to comply with this AUP. Capitalized terms not defined herein have the meaning set forth in the Terms of Service.

1. Purpose

Nodum provides a content analysis and research tool that enables users to retrieve, analyze, and process publicly available content from third-party sources. This AUP establishes clear guidelines for the responsible and lawful use of the Services. You are solely responsible for ensuring that your use of the Services complies with this AUP and all applicable laws.

2. Lawful Use Requirements

When using the Services to retrieve or process content from third-party sources, you must:

  • Comply with all applicable laws, including but not limited to the Computer Fraud and Abuse Act (CFAA), the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), the Digital Millennium Copyright Act (DMCA), copyright and intellectual property laws, privacy laws, and data protection regulations applicable in your jurisdiction;
  • Respect robots.txt and similar directives — where a third-party website or platform explicitly prohibits automated access through robots.txt, meta tags, or other standard exclusion protocols, you should not direct the Services to retrieve content from such sources unless you have verified that you have lawful authorization to do so;
  • Respect intellectual property rights — do not use the Services to retrieve, copy, reproduce, or distribute copyrighted content in a manner that infringes the rights of the original content owners;
  • Respect rate limits and server capacity — do not use the Services in a manner that overloads, overwhelms, or impairs the operation of any third-party server, API, or platform;
  • Comply with third-party terms of service — while Nodum does not independently verify compliance with third-party platform terms, you acknowledge that violating the terms of service of websites and platforms from which you retrieve content may result in legal consequences for which Nodum bears no responsibility.

3. Prohibited Uses

In addition to the prohibited activities set forth in the Terms of Service, you must not use the Services to:

  • Retrieve or process content containing personally identifiable information (PII) of individuals without their knowledge or consent, except where such processing is clearly authorized by applicable law;
  • Retrieve or process content related to children under the age of 13, or facilitate the exploitation or harm of minors in any way;
  • Access or attempt to access content that is behind authentication barriers, paywalls, or login requirements without proper authorization;
  • Circumvent, disable, or interfere with security features, access controls, CAPTCHAs, rate limiting mechanisms, or anti-bot protections implemented by any third-party platform;
  • Build, enhance, or contribute to databases of personal information about individuals without their consent;
  • Generate spam, phishing content, or engage in any form of social engineering;
  • Monitor, track, or stalk individuals through their social media content or online presence;
  • Retrieve content from government or military websites without authorization;
  • Use the Services to facilitate any form of discrimination, harassment, or illegal activity;
  • Resell, redistribute, or provide access to the Services to third parties without our written permission.

4. Data Handling Responsibilities

When using the Services, you are responsible for:

  • Determining lawful basis: Establishing and maintaining a lawful basis for retrieving and processing any third-party content under applicable laws;
  • Data minimization: Retrieving only the content reasonably necessary for your stated research, analysis, or reference purpose;
  • Secure storage: Protecting any content you obtain through the Services from unauthorized access, disclosure, or misuse;
  • Timely deletion: Deleting third-party content obtained through the Services when it is no longer needed for the purpose for which it was retrieved;
  • Transparency: Where required by applicable law, informing individuals whose content you process about such processing.

5. Enforcement

We reserve the right to investigate suspected violations of this AUP and to take appropriate action, which may include:

  • Issuing warnings
  • Temporarily suspending access to specific features or the entire Services
  • Permanently terminating your account
  • Reporting violations to relevant law enforcement authorities where required by law

We may take these actions at our sole discretion, with or without notice to you.

6. Reporting Violations

If you become aware of any violation of this AUP by another user, or if you are a third-party content owner who believes your content is being processed in violation of this policy, please report it to [email protected].

7. Updates to This Policy

We may update this AUP from time to time to reflect changes in technology, legal requirements, or best practices. Continued use of the Services after updates constitutes acceptance of the revised AUP.
